These Terms of Service ("Terms") govern your use of web hosting and related services provided by TexNode, a brand operated by Datasanct LLC ("TexNode," "we," "us," or "our"). By ordering, accessing, or using our services, you agree to these Terms.
TexNode provides shared web hosting and related services to businesses, primarily serving small businesses in Texas. Services include website hosting with email hosting, daily backups, and SSL certificates included on all plans, with optional add-ons such as domain registration, paid SSL certificates, and dedicated IP addresses available at the time of order or thereafter.
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use.
You agree not to use our services to host, transmit, or distribute any content or engage in any activity that is unlawful, infringes the rights of others, or harms our infrastructure or other customers. Prohibited activity includes but is not limited to:
Account storage is provided for the operation of your website — including site files, databases, and application assets that serve your website. Storage is not provided for general-purpose file storage, personal or business data backup archives, media libraries unrelated to your website, or file-distribution and file-sharing services.
Specifically prohibited are applications used primarily as personal cloud storage or file servers, including but not limited to Nextcloud, ownCloud, personal backup tools, and media streaming or download repositories. Data stored should be in service of your website's operation. We reserve the right to review storage use and contact you regarding accounts that appear to use storage outside this policy.
Email hosting is included with all TexNode hosting plans. Each plan includes a number of mailboxes hosted on TexNode infrastructure, with outbound email delivered via Amazon Simple Email Service (SES), a third-party delivery service we use to ensure reliable inbox delivery and strong sender reputation. While we manage the hosting and delivery infrastructure, Amazon SES's terms and acceptable use policies apply to outbound email sent through our platform.
Customers who prefer to use an existing email provider such as Google Workspace or Microsoft 365 may do so — we will configure the necessary DNS records as part of onboarding. TexNode email hosting and third-party email providers are mutually exclusive per domain.
Email accounts are provided for business communication purposes. Using TexNode email services to send unsolicited bulk email (spam), phishing messages, or any other abusive email is strictly prohibited and may result in immediate suspension.
Dedicated IP addresses are available as an optional add-on, subject to availability and justification requirements. IP address allocations are governed by the policies of the American Registry for Internet Numbers (ARIN) and our upstream provider. We reserve the right to request justification for any dedicated IP order and to decline requests that do not meet justification requirements. Common qualifying uses include IP allowlisting requirements with third-party services and specific application compatibility needs. Dedicated IP requests are not automatically provisioned — we will contact you to confirm your use case before assignment.
Each hosting plan includes defined limits on storage, bandwidth, and other resources. These limits are applied as soft limits — we will not automatically suspend your service for exceeding them. Instead, we will contact you to discuss your usage and, where appropriate, recommend a plan that better fits your needs.
Service fees are billed in advance on a monthly or annual basis, as selected at the time of order. The price you agree to at signup is the price you will pay at renewal; we do not use introductory pricing that increases at renewal. We will provide reasonable advance notice of any general price changes. Payment is processed through our third-party payment processor. Failure to pay may result in suspension or termination of service after reasonable notice.
You may cancel your service at any time directly through your client account, with no retention process or barriers. Cancellation takes effect at the end of your current billing period unless you request immediate cancellation. See our Refund Policy for details on prorated refunds.
Your data belongs to you. At any time during your service, and for a reasonable period following cancellation, you may export your website files, databases, and other data, and transfer your domain and SSL certificates to another provider. We will not withhold your data or obstruct your departure. We are happy to assist with the export and transfer process.
Daily backups are included with all hosting plans. While we maintain backups as a courtesy and operational safeguard, you are responsible for maintaining your own independent backups of critical data. We do not guarantee the availability or completeness of any particular backup and are not liable for data loss.
We strive to provide reliable, continuous service but do not guarantee uninterrupted availability. Services may be temporarily unavailable due to maintenance, upgrades, or circumstances beyond our control. We will make reasonable efforts to schedule planned maintenance to minimize disruption.
Support is provided primarily during business hours (Central Time). After-hours support for critical issues is available on plans that include it, as described at the time of order. A critical issue is one that renders a live website substantially inaccessible or non-functional.
We may suspend or terminate service for violation of these Terms, non-payment, or activity that threatens our infrastructure or other customers. Except in cases of severe abuse or legal requirement, we will provide notice and a reasonable opportunity to address the issue before termination.
To the maximum extent permitted by law, TexNode and Datasanct LLC shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of profits, revenue, or data, arising from your use of or inability to use our services. Our total liability for any claim shall not exceed the amount you paid us for the service in the three months preceding the claim.
Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We may update these Terms from time to time. We will post the updated Terms with a revised effective date and, for material changes, provide reasonable notice. Continued use of our services after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be subject to the jurisdiction of the courts located in Texas.
